Governor Tony Evers signed the budget bill

Today, Governor Tony Evers signed the budget bill passed by the legislature last week. However, he also issued his Veto Message in which he specifies 78 separate vetoes he made to the bill. 


While we are in still trying to gain a comprehensive understanding of the veto message, we want to provide you with the following vetoes of interest to WPHA/WALHDAB:

·  Treatment Alternatives and Diversion 

o This section creates a new appropriation to the alternatives to incarceration program in counties that currently do not participate in the alternatives to incarceration program. 

o To address concerns raised by the Attorney General, Gov. Evers is partially vetoing this section to remove the requirement that only counties that currently do not participate in the alternatives to incarceration program are eligible for funding from this appropriation. He objects to limiting flexibility for the Department of Justice. This change will ensure all the funds are invested in treatment alternatives and diversion. 

·  Defining Vapor Products Section 

o This section defines a "vapor product" and the bill imposes an excise tax and inventory tax of 5 cents per milliliter on vapor fluids. The bill further amends current law regulating the sale and taxation of tobacco products to include vapor products.

o Governor Evers partially vetoed the definition of "vapor product" in  because he objects to the ambiguous language in the definition. Specifically, the language could be erroneously construed to exclude liquids or other substances that are used in electronic cigarettes, electronic cigars, electronic pipes or similar devices. Such an interpretation would be contrary to intent. 

o As a result of the partial veto of this definition, the vapor products tax will clearly apply to any device containing vapor fluid and to vapor fluid sold separately.
